Privacy Policy Posted on Centercode for Field Testing Users

Introduction

Nest Labs, Inc., takes the privacy of all of our field test members, both past and present, seriously.

It is essential to our field test programs that we collect contact and other personal information from our members as explained below.  We provide this Privacy Policy to explain how we gather, share, and use information about you when you participate in the field test program, how we protect it, and how you can participate in its protection.  You choose to participate in this program, and you can stop participating in this program at any time.

We reserve the right to change this Privacy Policy. If we make changes to this Privacy Policy, we will notify you.

Information Collected

We require our members to provide personal contact information. This includes information such as name, address, phone number, and e-mail address. We also ask for personal information such as age, gender, marital status, education, languages spoken, employment status, household income, and the amount of time you have available to participate in a field test.  

In addition to personal data, you will be asked to provide details regarding any products you own which relate to certain products which may be available for field testing. We refer to these as Test Platforms and they include items such as a personal computer, peripheral device, audio and video components, cellular phone, home heating and cooling systems, or any number of other products.  If you want a family or household member to participate in the program, you can provide to us the name and email address associated with that individual’s Google Play store or Apple ID account, as applicable.

When you participate in the Nest field test program and field test Nest products and services, we also collect information about those products and services, and your use of those products and services.  Please review the disclosures in our Privacy Statement where we explain the categories of information we collect from anyone that uses any of Nest’s products and services.  

Information Use

This information is collected and used for the following purposes:

  • identifying individuals who match the profile required for participating in each field test. Not all information is required in order to complete the registration process, but supplying this data will increase the number of test participation opportunities available to you.

  • Analyzing, developing, operating, improving, researching, customizing, and testing Nest’s existing products and services and developing new Nest products and services.

  • Communicating with you.

  • Promoting safety and security on and off Nest’s services.

Information Sharing

As a condition of participating in the field testing program, you agree to permit Nest employees access to all the information collected by our products for the purpose explained above.  You also agree that we can share your information with:

  • vendors acting as service providers for us;

  • partners (such as app stores) to facilitate delivery of software or services to you or your family or household members participating in the program;

  • third-parties for legal reasons (if we have a good faith belief that access, use, preservation or disclosure of the information is reasonably necessary to (i) meet any applicable law, regulation, legal process or enforceable government request; (ii) enforce Nest policies or contracts, including investigation of potential violations; (iii) detect, prevent or otherwise address fraud, security or technical issues; (iv) protect against harm to the rights, property or safety of Nest, our users or the public as required or permitted by law); and

  • third parties in aggregate form for any purpose.

Security

Centercode, the publisher of the software used by the Nest Field Test Community, has sophisticated security measures in place to help protect against the loss, misuse, and alteration of the data under Nest's control. When accessing the Nest Field Test Community via a supported Web Browser, Secure Socket Layer (SSL) technology protects information using both server authentication and data encryption to help ensure data is safe, secure, and available only to you.

Centercode also implements an advanced security method based on dynamic data and encoded session identifications, and hosts the Nest Field Test Community in a secure server. Finally, the Nest Field Test Community requires unique usernames and passwords that must be entered each time a member logs on. These safeguards help prevent unauthorized access, maintain data accuracy, and ensure the appropriate use of data.

Cookies

Cookies are files that Web browsers place on your computer's hard drive to help authenticate and identify you. We use cookies to save and retrieve your authentication information and personal settings. This is intended to help provide you with a secure and user friendly experience.

Miscellaneous Notices

We collect, use, and share your information as necessary to fulfill the terms of the agreements we have entered into with you; consistent with your consent, which you can revoke at any time; as necessary to comply with our legal obligations; occasionally to protect your vital interests, or those of others; as necessary in the public interest; and as necessary for our (or others') legitimate interests, unless those interests are overridden by your interests or fundamental rights and freedoms that require protection of personal data.

Your information may be collected, processed and stored by Nest Labs Inc. or its service providers and affiliates in the United States and other countries where our servers reside.
